Elon Musk’s xAI sued a user on Tuesday, alleging he used the Grok chatbot to create child sexual abuse materials. It’s one of the first lawsuits filed by a tech company against users who allegedly create explicit content with AI.
Oh, he’s trying to distract people from the fact AI generated content doesn’t fall under safe harbor laws and he as the owner has liability if negligence in xAI’s safeguards can be proven.

Looks like Musk finally learned Trump’s tactic of accusing someone else of what he’s doing to poison appropriate blame.

So. The company could have just turned over the proof to the police and let them prosecute him for CP/CSAM. Instead they decided to do this? Why? I doubt he’s got money they can take. It’s certainly not to protect the “good name”. This seems like they just want to be seen doing something and they picked the worst thing to be seen doing.

Exactly. This should be a criminal matter, not a civil one… and xAi should be one of the defendants.
I think nekokoneko above has it right, trying to misattribute blame to the user. Basically, he wants to blame the user for using the service, instead of fixing the service so it doesn’t produce heinously horrible things on request. It shouldn’t work, but who knows with the amount of money he has and the lack of money on the other side. The goal is to establish a small precedent, though if someone sues xAI for making a product that makes this kind of refuse, I doubt such a precedent would hold much water.
At first I wasn’t sure if they were suing the (now) dead guy from https://arstechnica.com/tech-policy/2026/07/lawsuit-grok-user-made-7k-child-sex-images-xai-only-reported-one-gang-rape-prompt/ but I think that one was in Wyoming per the legal docs. Grok has certainly been busy generating CSAM.
Jesus Christ that’s insane. 7k images means at least 7k prompts, and the only one that got flagged was “gang rape”.
Why do these article make it sounds like baseless lawsuits are not trivial to file in the USA?
It’s like the gun manufacturers sue it’s users for using their guns to shoot people.
At the very least, gun companies don’t have an anonymous suggestion box for who to kill, and they aren’t the ones sending out assassins to do the killing. And the assassin doesn’t live in a mansion funded by taxpayers and foreign interests.
Grok tends to generate children in images even when not told to do so
